Notice of the Ministry of Land and Resources on Terminating the Implementation of Article 55 of the Notice on Issuing the Interim Provisions on the Administration of the Assignment or Transfer of Mining Rights

国土资源部关于停止执行《关于印发〈矿业权出让转让管理暂行规定〉的通知》第五十五条规定的通知

The competent departments of land and resources of all provinces, autonomous regions and municipalities directly under the Central Government; the Land and Resources Bureau of Xinjiang Production and Construction Corps; China Geological Survey; the Headquarters of Gold-Mines Guard of the Chinese People's Armed Police Forces; other entities directly under the Ministry of Land and Resources; all local bureaus of state land supervision; and all departments and bureaus of the Ministry of Land and Resources:      

各省、自治区、直辖市国土资源主管部门，新疆生产建设兵团国土资源局，中国地质调查局，武警黄金指挥部，部其他直属单位，各派驻地方的国家土地督察局，部机关各司局：

In accordance with the relevant provisions of the Property Law of the People's Republic of China and the Guarantee Law of the People's Republic of China, to ensure that property right holders exercise the right to mortgage according to law, the implementation of Article 55 of the Notice on Issuing the Interim Provisions on the Administration of the Assignment or Transfer of Mining Rights (No. 309 [2000], MLR) shall be terminated   

根据《中华人民共和国物权法》、《中华人民共和国担保法》的有关规定，为保证财产权人依法行使抵押权，现停止执行《关于印发〈矿业权出让转让管理暂行规定〉的通知》（国土资发〔2000〕309号）第五十五条规定。
